Contact an Attorney

The team of lawyers at Dadvocates is available anytime–including after hours and weekends–to begin working on your case. Contact our Denver practice to schedule a consultation and we will discuss your options on how to proceed.

Prepare Your Case

In order to be convicted, the prosecution must prove your guilt beyond a reasonable doubt. Our attorneys will expose weaknesses in the prosecution's argument in order to develop the very best defense.

Pre-Trial

Pre-trial procedures involve an arraignment where a judge will formally read your charges. You will enter a plea of guilty or not guilty that you are able to change at a later date. The arraignment is followed by a series of pre-trial hearings including motions and readiness hearings designed to ensure your fair due process.

Trial

The majority of the time, we will be able to reach an outcome before heading into a trial. However, we will prepare your defense to go to trial if this is the best course of action to ensure a just outcome. Our attorneys will never back down in their fight for your rights.

Potential Penalties

The severity of the crime depends on the value of the item(s) stolen. Depending on this factor and others, such as prior convictions, you can be charged with a misdemeanor or felony. Here is a general overview of the penalties that apply to theft cases...

Misdemeanor

A misdemeanor theft crime includes stolen property within the range of $50 to $2,000. Anything less than $50 in value is considered a Class 1 Petty Offense. The most severe Class 1 Misdemeanor can come with a 6-18 month prison sentence.

Felony

When the value of the stolen goods exceeds $2,000, the state of Colorado classifies the crime as a felony of varying degrees. The punishment for felony theft is severe and can include fines in the hundreds of thousands of dollars, as well as multiple years in jail.

Establishing a Defense

The goal of the Dadvocates law firm in Denver, Colorado, is to establish a solid, justifiable defense for our clients charged with a crime. There are many reasons a person may be accused and innocent of a charge. We will examine your theft case and prepare a defense in situations of...

Right to Property

A valid defense for a theft crime is a good faith belief that you had a lawful claim to the property you took.

Mistaken Intent

The prosecution must show that you had the intent to steal in order to be convicted of the crime. For example, if a defendant simply forgets to pay for an item or has the intention of returning the property, this is a valid defense.

Lack of Pretense

This can be a successful defense for clients who have no reason for wanting to steal the property they are accused of taking.

Impaired Mental State

It is possible to successfully defend theft charges if you were intoxicated or under duress at the time the alleged theft crime occurred.

Entrapment

This defense applies if you are lured into committing a theft crime with the intent to prosecute.

I called Dadvocates to find legal advice about a particular sensitive situation I was dealing with.  I don't typically like calling law firms because I find they provide minimal advice while running up my tab.  But in this case, Jason and Kaitlyn really helped me out.  They gave me a free consult and I got all the answers I needed at the time.  These two attorneys are very professional and I really believe they have their clients' best interest in mind.
