Potential Penalties
Misdemeanor
A misdemeanor theft crime includes stolen property within the range of $50 to $2,000. Anything less than $50 in value is considered a Class 1 Petty Offense. The most severe Class 1 Misdemeanor can come with a 6-18 month prison sentence.
Felony
When the value of the stolen goods exceeds $2,000, the state of Colorado classifies the crime as a felony of varying degrees. The punishment for felony theft is severe and can include fines in the hundreds of thousands of dollars, as well as multiple years in jail.

Establishing a Defense
Right to Property
A valid defense for a theft crime is a good faith belief that you had a lawful claim to the property you took.
Mistaken Intent
The prosecution must show that you had the intent to steal in order to be convicted of the crime. For example, if a defendant simply forgets to pay for an item or has the intention of returning the property, this is a valid defense.
